Supplemental Affidavit of Joey Mahmoud in Support of the Request for Pipeline Route 
Deviation and Application of Dakota Access, LLC, for an Amended Corridor Certificate and 
Route Permit, and the Application for Waiver or Reduction of Procedures and Time Schedules

Joey Mahmoud, being first duly sworn upon oath, states and alleges as follows: 

1 . That I submit this supplemental affidavit in support of the Request for Pipeline 
Route Deviation and Consolidated Application for an Amended Certificate of Corridor 
Compatibility and Route Permit (“Application”) and the Amended Application for Waiver or 
Reduction of Procedures and Time Schedules (“Amended Waiver Application”), filed by Dakota 
Access, LLC (“Dakota Access”) in the above-captioned matter. 

2. That I am employed as the Vice President of Engineering for Dakota Access for 
the Dakota Access Pipeline Project (the “Project”). 

3. That on January 20, 2016, the North Dakota Public Service Commission 
(“Commission”) issued its Order granting Dakota Access a Certificate of Corridor Compatibility 
and Route Permit for the Project (“Order”). 

4. That on April 5, 2016, Dakota Access submitted a request to the Commission for 
approval of various modifications to the approved Project route and corridor in Mountrail, 



Williams, McKenzie, and Dunn Counties, North Dakota as set forth in the application materials 
and supporting documentation and exhibits. See PSC Docket No. 156. 

5. That the modifications to the Project are a result of landowner and agency 
requests, as further explained in the Amended Waiver Application. 

6. That as noted in the initial affidavit in support of the Application, all owners of 
the property to be crossed by the modified route have approved the proposed modifications. See 
PSC Docket No. 156. 

7. That as of the date of this supplemental affidavit, Dakota Access has obtained one 
hundred percent (100%) of the easements necessary for the proposed modified route and 
corridor. 

8. That some of the easements obtained from the applicable landowners contain 
confidential information. For the easements including confidential information, a memorandum 
of easement was recorded with the relevant county recorder’s office instead of the easement. 
When possible, the easements were filed with the relevant county recorder’s office. Attached 
hereto as Exhibit H are all easements or memorandum of easements applicable to the route 
modifications. 

9. That Dakota Access will comply with the Commission’s orders, laws, and rules 
designating the corridor and designating the route for any amendments to the corridor and route 
as requested.
